Hospitals treating Medicaid patients face additional cuts under Affordable Care Act

Hospitals that provide uncompensated care in states that do not offer expanded Medicaid access may face an additional burden in 2014 as a result of cuts to Medicaid under the Affordable Care Act, according to a study published in the New England Journal of Medicine.U.S. hospitals that are paid funds from the Medicare and Medicaid disproportionate share (DSH) will receive a 75% across the board cut to the DSH under the Affordable Care Act. However, if their state does not expand Medicaid access, who becomes covered in each state will vary widely, stated John A. Graves, PhD, in a news release.

CMS issues final rule on Physician Payment Sunshine Act

CMS recently announced in a press release its final rule on the National Physician Payment Transparency Program: Open Payments, also known as the Sunshine Act, aimed to increase transparency among physicians, drug and device manufacturers and health care providers. As part of the Affordable Care Act, the rule calls for manufacturers of drugs, devices, biologics and medical supplies reimbursed by Medicare, Medicaid or Children’s Health Insurance Program to disclose payments made to doctors and teaching hospitals to CMS. According to the release, these manufacturers and group purchasing organizations must also report physician ownership and investments in these enterprises. This data will be publicly available on a CMS website by September 30, 2014, and entities required to report information under the rule will be able to review and correct reported data before it is released to the public. Collection of this information will begin August 1 of this year, according to the release.

New Affordable Care Act rules proposed this week by HHS Secretary Kathleen Sebelius set guidelines for eligibility notices and appeals in Medicaid, the Children’s Health Insurance Program and Exchanges, plus give states additional operational flexibility for Medicaid programs.“Today, we are proposing a rule to provide Americans with access to affordable, high-quality health coverage and give states more flexibility to implement the law in a way that works for them,” Sebelius said in a press release.

On Feb. 1, 2013, the Centers for Medicare and Medicaid Services (CMS) issued its long-awaited final rule regarding the implementation of the physician payment sunshine provisions of the Affordable Care Act. The final rule does not create any new prohibitions on payments to physicians and teaching hospitals, but rather sets out new dates and requirements for manufacturers and other entities to collect data about their payments to physicians and other “covered recipients” and submit that information to CMS. Applicable manufacturers and group purchasing organizations (GPOs) must begin to collect this data on Aug. 1, 2013 and report the data to CMS by March 31, 2014.

The Congressional Budget Office recently released its Budget and Economic Outlook: Fiscal Years 2013 to 2023, which lowered the estimate to hold current payment rates under the sustainable growth rate for 10 years from $243.7 billion to $138 billion. “We welcome the news from the [Congressional Budget Office] CBO that the cost of permanently replacing the flawed Medicare physician payment formula, known as [sustainable growth rate] SGR, has decreased dramatically,” AMA President Jeremy A. Lazarus, MD, stated in an AMA press release. “The new cost of freezing payments for 10 years is $138 billion, more than $100 billion less than the previous projection. The rate of Medicare spending growth declined compared to historical trends, and spending for physician services affected by the SGR is projected to be far less than previously estimated.”
