Був в одному селі на Волині, де наш екскурсовод показав нам колонну на честь встановлення магдебурзького права в цьому селі. Колонна стоїть прямо на приватному городі поблизу костелу і церкви. А де їй стояти?! Лише стадо кіз нагадує, що це село вже не потужний осередок місцевого самоврядування. Але минули часи, право міських громад паплюжили всі завойовники, а тому воно занепало і пропало.

Коли в роки становлення незалежності в Україні місцеві громади отримали закон "Про місцеве самоврядування в Україні", це було дуже сучасним і демократичним. Громади обрали "мерів", але замість нової якості життя, отримали перші гірки наслідки свободи і демократії - хабарництво, корупцію, безлад. Але ж громади не мали досвіду обрання "слуг народу" і вірили всім, хто обіцяв краще життя.

Таким становищем скористалися нові "господарі життя", яких раніше називали королями, магнатами чи князями. Спочатку був закон "Про державні адміністрації", який створив паралельну більш економічно потужну структуру, яка мала більш суттєві повноваження і важелі впливу на життя міста.  Фактично в Україні були створені ради депутатів і державні адміністрації, які конкурували між собою, але сили були не рівні, бо зароблені містом чи селом гроші, все одно залишалися в розпорядженні адміністрації, а не органів місцевого самоврядування.

Таким чином "хороший" для влади очільник місцевої громади отримував фінансування, а не покірливий представник громади спричиняв громаді лише збитки і розпач, бо його плани були завжди не здійсненні. Так ми і жили всі ці роки. Так занепало місцеве самоврядування і ми спостерігаємо скорочення цих органів і їх прав. Отже майбутнього у права місцевої громади на самовизначення і самостійне управління місцевими справами немає і не буде, бо нема кому навіть пригадати, що таке вже було і закінчилося не на користь звичайних громадян,  що прагнуть свободи і справедливого порядку. От і знову кортить пригадати Екллезіяста: "Немає пам'яті про минуле; а також про те, що буде, не залишиться пам'яті в тих, котрі прийдуть потім."

От ми прийшли - незалежні Українці, забули про минуле, навіть пам’ятники минулого, що нагадували про права територіальних громад, віддали для розведення городу чи випасу кіз. Спаплюжили кращі мрії поодиноких вчених, правників  і просто свідомих громадян, щодо встановлення в Україні дієвого, самобутнього права громад визначати свою спільну долю. Навіть наші президенти не можуть зрозуміти, що сильна міська громада, це укріплення саме його влади і послаблення місцевих князьків, які не зацікавлені у втручання в іх темні справи навіть з боку президентів.

Так скоро дійдемо до феодалізму чи кріпацтва, а поодинокі пам'ятки минулого зруйнуються природою, яка вже стомилася чекати від нас розумних, свідомих дій спрямованих на встановлення в Україні порядку і забезпечення добробуту саме громадян. Я гадаю, що поки ще стоять ці пам'ятки є надія на поновлення самоврядування в Україні, але оцініть скільки в нас залишилося часу?!
